Effective August 8th, 2012, Nevada's existing underground storage tank regulations contained in Nevada Administrative Code 459.9921 to 459.999 will be amended to include an operator training component of underground storage tank regulation. Operator training requirements are designed to ensure that operators have the appropriate knowledge regarding the operation and maintenance of underground storage tank systems.
What are the operator classes? Class A operators have primary responsibility to operate and maintain the underground storage tank system including
Class B operators implement applicable underground storage tank regulatory requirements and standards in the field including day-to-day aspects of operating, maintaining, and record keeping. Class C operators are employees responsible for the initial response to alarms or other indications of emergencies caused by spills or releases from an underground storage tank. |
Underground storage tank owners or operators must identify, for each underground storage tank system or group of underground storage tank systems at a facility, at least one name for each class of operator. The owner or operator must keep a record of these designated operators and make the records available for review by the State or its representatives.
Why would I want to designate a company instead of one of my own employees?
Typically Class-A operators (station owners, responsible parties) do not change very often; however, Class B and C operators can change quite frequently. Every time a Class B employee (typically a store manager) is hired, a Class B training for that employee will need to be completed and site designation will have to be made. If you are a multiple site operator this can be quite cumbersome in maintaining all certifications and records. If our company is designated as your class-B operator you will not be faced with changing any regulatory documents or training each time a class-B operator is moved around your organization. In addition, our company has the training and experience to be able to identify areas of non-compliance much quicker and more accurately than a newly trained operator.

Am I still liable if I designate Ideco-NV, Inc. as my class-B operator?

All compliance requirements in Nevada statutes and regulations, including the requirements to demonstrate compliance with operator training, are placed on the "owner or operator of an UST." This structure has not been changed by the adoption of operator training provisions, including the requirement that a Class A, Class B, and Class C operator be designated for all tanks.
